The Shortlyst – Terms and Conditions
These terms and conditions (T&C) are an agreement between The Shortlyst Directory (Directory) and anyone, any company, any service or other submitting/posting a listing. The Directory is administered by The Shortlyst team (TSL).
Purpose and Ethos
The purpose of the Directory is to hold and promote information of beauty-based businesses for the use of their future customers. Listings can be submitted from all business owners, whether that is a solo mobile worker, a home-based salon or a business premises, who are providing a beauty service.
Accounts
By creating an account, you are confirming that you are at least 18 years of age. The lead individual opening the account is wholly responsible for and representative of all content within a listing including any media published; all activity and security of the account; any actions or activity taken in connection with it. Providing false contact information of any kind may result in termination of the account.
You must immediately notify us of any unauthorised uses of your account or other breaches of security. TSL or any partner organisation of the TSL network, including Jax PR LTD, are not responsible or liable for any acts or omissions by account holders including any damages of any kind. If an account is blocked or disabled, you may not re-register.
User Content
TSL or any partner of the TSL network do not own any data, information or material that you submit on the directory. Account holders have the sole responsibility for the accuracy, integrity, legality, reliability, appropriateness and intellectual property ownership or the right to use all submitted content. All submissions will be read before publishing by the TSL admin team to check for appropriate language; political; discriminatory or other content based on the ethos of the Directory’s purpose. TSL have the sole discretion to refuse or remove any content that, in our reasonable opinion violates these T&C, the purpose and ethos, or that we feel is in any way harmful or objectionable in any way.
User reviews of any services are also subject to the same scrutiny and may be removed if deemed offensive or deliberately targeted to affect a business listing in a derogatory fashion. However, honest feedback is encouraged and will be protected where a review has been given genuinely.
Accuracy of Information
Occasionally there may be information on the directory that contains typographical errors, inaccuracies or omissions that may relate to services of other information. TSL reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.
Links to other websites
Although the Directory has the ability to link to other websites, TSL is not, directly or indirectly, implying any approval or association, sponsorship, endorsement or affiliation with any linked website, unless specifically stated. TSL is not responsible for examining or evaluating, and do not warrant any businesses or individuals or the content of external websites. TSL do not assume any responsibility or liability for the actions, services, products of other third party websites or any listing held within the Directory. Linking to other websites is at your own risk.
Prohibited uses
You are prohibited from using the Directory or any of its content: (a) for unlawful purpose (b) to solicit others to perform or participate in unlawfual acts (c) violate any law, regulations, rules whether that be local or international (d) infringe upon or violate our intellectual property or that of others (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age national origin or disability (f) to submit false or misleading information (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Directory or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Directory or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Directory or any related website for violating any of the prohibited uses.
Disclaimer
You agree that the use of the Directory is solely at your own risk. You agree that the Directory is provided on an “as is” and “as available” basis. We make no warranty that the Directory will meet your requirements, or that the Directory will be uninterrupted, time, secure, or error-free; nor do TSL make any warranty as to the results that may be obtained from the use of the Directory or as to the accuracy or reliability of any information obtained through the Directory or that defects in the Directory will be corrected. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of Directory is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data. TSL make no warranty regarding any goods or services purchased or obtained through the Directory or any transactions entered into through the Directory. No advice or information, whether oral or written, obtained by you from us or through the Directory shall create any warranty not expressly made herein.
Indemnification
You agree to indemnify and hold TSL, staff or volunteers from and against any liabilities, losses, damages or costs, including reasonable legal fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Directory or any willful misconduct on your part.
Severability
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
Memberships
All paying packages are gifted one, free, three-month trial. To qualify, payment details must be provided during the sign-up process.
No debits will be taken should the membership trial be cancelled during the trial period.
All memberships are for a minimum of 12 months following the trial period.
Memberships after this period can be cancelled with one month’s notice by e-mailing Hello@TheShortlyst.com or using the cancel service button on the dashboard online.
Founders Memberships
Up to 100 Founders memberships have been made available during the pre-launch of TSL. This qualifies those who sign up, to our most premium package, with additional extras, at the enhanced package price. This monthly cost price will never increase.
Founders will keep their status, and identified with an exclusive badge, for the lifetime of their membership. Any break in membership will void their status.
Benefits of the Founders package are available once the trial period has been completed.
£99 package
In addition to our membership packages, we offer a service to create your page for you. This is a one-off price to set up and connect your page by one of our web-designers. The web-designer will be limited by the membership package you have chosen to purchase. Work is intended to be completed within one-week of receiving the details of the company. One revision is available for the client to adjust the content on the page. No further work can be undertaken, including updates of photos, prices, attachments or content once the page has been signed off.
Sign off of the page is automatically declared after 14 days of submission of a draft.
Complaints
If you have any complaint about any service listed on the Directory, you should let TSL know in the first instance where will consider whether any changes need to be made or whether a listing can remain.
If we receive a complaint about a service or listing, the listing will be suspended by TSL until changes that are deemed necessary are made. All decisions are subject to a decision within 7 days. It is the sole discretion of TSL as to whether a listing is reinstated.
Changes and amendments
TSL reserve the right to modify this Agreement or its policies relating to the Directory at any time, effective upon posting of an updated version of this Agreement on the Directory. When we do, we will revise the updated date at the bottom of this page. Continued use of the Directory after any such changes shall constitute your consent to such changes.
Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Directory you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Directory.
